COVID-19 - New York Paid Disability & Family Leave Options

The state of New York enacted a new law on March 18, 2020 that requires most employers to provide Paid Sick Leave of one to two weeks, depending on employer size and income, to employees unable to work due to COVID-19 quarantine or isolation orders. For more information on New York’s Paid Family Leave and disability programs, please visit our New York page.

If You Are Quarantined Yourself

We know many people have been ordered to stay in their homes to prevent the spread of COVID-19. If you are under an official mandatory or precautionary quarantine or isolation order issued by the State, New York State Department of Health, local Board of Health, or other authorized government entity, you may be eligible for Disability and Paid Family Leave benefits. You may not have to be sick to take this Leave, but you do have to be under an official quarantine or isolation order.

This specific Leave depends on the size of your employer and their net annual income as of January 1, 2020. Please note this benefit is not available if you are not diagnosed with COVID-19 or symptomatic and you are able to work through remote access or other means. If you work for an employer with less than 100 employees, you can access the online forms here or download them below to apply for these Leave benefits.

If Your Minor Dependent Is Quarantined

We know many schools have closed and millions of children have been ordered to stay home to prevent the spread of COVID-19. If your child is under an official order of mandatory or precautionary quarantine or isolation issued by the State, New York State Department of Health, local Board of Health, or other authorized government entity, you may be eligible to take New York Paid Family Leave. If you qualify, it means your job will be protected while you take Paid Time Off during this crisis. Your dependents don’t have to be sick for you to take this Leave – it’s enough if they’re under official quarantine or isolation orders.

Please note this benefit is not available if you are able to work through remote access or other means.  You can access the online dependent forms here or download them below to apply for these Leave benefits.
